What JC Penney must do to fix itself

For JC Penney, it's going to have to be a trip back to the future if it wants to woo the customers it alienated with its failed no sales, no discounts policy. Apparently, Americans love their coupons.

A day after the struggling retailer ousted the Ron Johnson, the architect of the policy, retail industry analysts said JC Penney's newly reappointed CEO Myron Ullman would need to revive discounts and promotions that its loyal customers knew and loved.

"You have to have the discounts, but then you have to have full price, too," said Dana Telsey, chief executive of Telsey Advisory Group. "You have to give the consumer product that they're willing to pay full price for, and that's branding the store."

In a report issued on Monday, JP Morgan analysts said they expect the company will return to coupons and promotions as part of an effort to stabilize itself before the crucial back-to-school season.

It would be a repudiation of Johnson?s attempt to reinvent JC Penney, which had already been struggling before he left Apple to take the helm at the retailer.

With Johnson as CEO, the company set out to transform itself into a series of shops within a store and rebrand itself into "America's favorite store" as part of a multi-year makeover. Analysts said, however, that the private-label brands carried little to no meaning in today?s market.

"We are convinced JC Penney needs a compelling way forward ? but what that is remains to be seen," they said. "Johnson's path of aspiring to a new shopper did not work, but JC Penney struggled to stabilize sales before Johnson's arrival."

In the process of going after a new customer base, the company also lost touch with its core customer and saw its same-store sales nose dive 25 percent last year. Same-store sales measure sales at stores open more than a year and are considered more accurate because they smooth out wrinkles caused by the hype and excitement after a new store opens. Its share price also shed about half its value and the company recently reported a $552 million quarterly loss.

In a tough economic environment where consumers have been pinching every penny, Johnson?s plan backfired and competitors pounced on the opportunity.

Telsey said for JC Penney to succeed, it would have to lure its core customers back ? a move that she said is possible.

"You're not going to get back all the sales you lost, but you can certainly make improvements on what you have," she said.

Ullman, who served as JC Penney?s CEO for almost seven years until 2011, returns to Penney roughly one third of the way into its transition to a shops-within-a-store model, a transition that "has thus far displayed only scant evidence of success," Oppenheimer analysts said.

Looking ahead, analysts expect Ullman to continue with the transformation of Penney's home goods section, which includes 33 shops by May, but to examine plans after this and possibly slow the conversion rate to conserve cash.

It's noteworthy that Ullman, rather than Johnson, was the first to introduce the shop-in-shops concept when he partnered with Sephora in 2006 and MNG by Mango four years later.

To cut costs amid flagging sales, Johnson turned to widespread layoffs during his tenure, a move that Citigroup analysts said reduced morale at the retailer. Boosting this morale, along with recruiting talent, are two priorities for Ullman, Citigroup analysts added.

"We believe Mike will tap his retail Rolodex and past JC Penney management to bring back department store talent the organization," they said while also fostering internal talent.

AZ Electronic shares slide after profit warning

LONDON (Reuters) - AZ Electronic Materials, a maker of chemicals for Apple's iPad displays and memory chips, warned that profit would be lower than expected in the first half, wiping a quarter of the value of its share price.

The company said on Tuesday that its core earnings margin for the first six months of the year would dip below 30 percent, resulting in 2013 group margins coming in below normal levels. It forecast an improvement in the second half.

A weaker than expected performance in the part of its business which provides materials used in integrated circuits was to blame, said the company.

Shares in AZ Electronics crashed 27 percent to 269 pence at 3:43 a.m. ET, hitting their lowest level for around nine months and leading the FTSE 250 losers board.

"Softness in demand patterns within the integrated circuit industry was compounded by increased pressure from dual sourcing by certain customers," AZ said in a statement.

Analysts at Singer called the update "disappointing" and said that the lower than normal margin implied a possible 2013 earnings downgrade of over 10 percent.

"We believe that a number of the challenges are likely to be short term ... but we expect the shares to come under some pressure pending visibility of the anticipated second half recovery," they said.

AZ said discussions with customers meant it was confident of a stronger second half. It also gave assurances on profit growth beyond 2013 citing encouraging progress on the development of new products.

'Voodoo stuff' used against would-be North Miami mayor

Anna Pierre's introduction to North Miami politics has included intimidation and voodoo tactics.

On Easter Sunday somebody placed voodoo artifacts outside the door of her campaign office.

"I wish I knew," said Pierre, when asked if she had any idea who did it.

She said thinks one of her opponents may be behind the intimidation.

Pierre, who is not related to current Mayor Andre Pierre, is running for mayor.

She says the tactics against her have also included nasty phone calls and sign stealing.

The voodoo items placed outside her campaign office have included candles, food and dolls with pins stuck in them.

"At first it bothers me," she said. "Not that I am scared, but to see how dirty, how low can people go."

Voodoo is practiced by people in Haiti, and around the world, including the U.S. Voodoo has a spooky reputation, but it is a bona fide religion.

There is a huge Haitian population in North Miami.

Pierre said she's famous in her birth country of Haiti, recording a hit pop song before coming to America.

Her popularity there, she says, is helping her gain support here as she runs for mayor.

"The voodoo stuff, I don't know who's doing it, but I'm not afraid," she said. "It's just intimidation to ...? slow me down. But you know what? I'm not going to slow down until the finish line."

How Thatcher's radical policies became the norm

LONDON (Reuters) - More than three decades after Margaret Thatcher became Britain's prime minister, her economic legacy - reviled and revered - still ripples across the world.

Whether it is euro zone finance ministers demanding debt-laden countries privatize state-run companies, U.S. politicians seeking spending cuts and curbs on unions, or Britain itself putting its Royal Mail on the auction bloc, the tenets of Thatcherism, for better or worse, are alive.

Thatcher, who died on Monday aged 87, stood for deregulation, a smaller state, free markets and privatization. If that sounds familiar, it is because her playbook has been copied around the world.

None of those policies were common in 1979 when Thatcher became Britain's first woman prime minister with the country reeling in post-war economic decay.

"She shifted the boundaries of what was politically possible," said Steve Davies, a director and economic historian at Britain's Institute of Economic Affairs think tank.

"On the one side policies such as privatization and deregulation came to be taken seriously. On the other, policies that were taken seriously - like the command economy - are no longer taken seriously."

Thatcherism - and its U.S. cousin Reaganomics, after the president, Ronald - were seen as radical departures. The term privatization, for example, was barely known before her tenure. A Google search in 2013 brings up more than 14.5 million hits.

When Thatcher took over Britain, much of its industry like those of other European countries was in the hands of the state.

She sold off steelmakers, carmakers, aerospace firms, oil and gas giants, airlines and the telecoms monopoly - often to strong objections from political opponents and workers within the former state-owned industries. Even public housing was offered for sale, at a discount, to the tenants who lived in it.

There is still opposition. The U.S. public services union ASCME, for example, describes privatization as "driven by wrong-minded public officials and corporate greed."

And not all privatizations were successful. Bold competition has brought down costs and encouraged growth in some areas such as telecommunications. Complex, heavily infrastructured businesses such as railways - privatized by her successor John Major - have arguably done less well.

But the debate now is generally on how far privatization should run, not on whether it should be unwound.

Sell-offs of state-owned businesses are now a de rigeur part of euro zone bailout programs. In Greece, the European Union/International Monetary Fund bailout requires the sale of real estate, more than 20 companies, and dozens of marinas and ports.

Thatcher's economic influence outside of Britain was most visible in Eastern Europe. After the fall of the Communist bloc at the end of her tenure, new leaders there made her a hero and embraced privatization as the express route to capitalism.

In many countries the transfer of state assets to private hands was a success; in others, less so.

In Russia, a privatization scheme designed by self-professed Thatcherites was brazenly run by its own beneficiaries. It awarded the crown jewels of Soviet industry to a handful of politically-connected insiders, creating a caste of overnight billionaires, more than a few of whom would later become Thatcher's neighbors in London's exclusive Belgravia district.

"The emergence of oligarchic structures and dramatic increases in inequality... demonstrate the limitations of applying Baroness Thatcher's legacy too literally," said Erik Berglof, chief economist at the European Bank for Reconstruction and Development.

DEREGULATION

Thatcher's "big bang" deregulation of British financial markets saw the City of London strut into its role as Europe's banking capital, and helped turn global finance into the swaggering industry it became for the past generation.

Other industries faced the opposite fate on her watch. Her biggest battles were with coal miners, in a state-run sector that was already in rapid decline after Britain discovered cheaper, safer and cleaner offshore natural gas.

When she took power there were nearly a quarter of a million coal miners in Britain, sustaining communities that had known little else since the industrial revolution. When she left there were barely 50,000 people still working in the mines. Today only a few thousand remain.

Her embrace of deregulation would get mixed reviews at the moment, given the excesses that led to the financial crisis of 2008. Indeed, there has been something of a backlash against the relatively unfettered wealth-creation Thatcher espoused.

"Thatcher created a more dynamic and laissez-faire society, but the social cost in terms of communities destroyed was immense," said Timothy Ash, a strategist at Standard Bank who remembers long lines of police vans outside his school, which was adjacent to a coal mine that was later closed down.

But free market economics - epitomized by Europe's single market, which Thatcher supported even as she waved her handbag threateningly at much of the rest of the bloc's ideas - has become the dominant economic philosophy in most of the world.

Again, the argument today is on the issue of how much you can protect your economy or control excesses, rather than on the assumption that you should run things from the center.

"There are still legitimate question about outcomes," said Glenn Hubbard, dean of Columbia University Graduate School of Business in New York. "But she tremendously advanced the case of free markets for goods, capital and labor around the world."

Microsoft to build first innovation center in China, has software development in mind

Microsoft's relatively often finding ways to encourage software development in various fields, and the company's latest venture has it setting footsteps near the Great Wall. According to a report by news agency Xinhua, the software (and hardware) company has reached a deal with China's Hainan government that will see it build an innovation center in this territory. Focusing on IT development and skills in tourism and agriculture, this new property will be the first of its type in China, and Microsoft has high hopes that the joint efforts can, aside from becoming a crossroads of knowledge, also "boost the region's efforts to become a major international tourist destination." Frankly, seeing as how the highly populated nation doesn't appear to be slowing down its all-around growth anytime soon, it wouldn't surprise us if Redmond decides to start setting up more of these in the years to come.

Dem, GOP senators work on background check deal

WASHINGTON (AP) ? Senate aides say a Democratic and a Republican senator are working on a compromise expanding required federal background checks to gun shows and to online firearms sales.

If an agreement could be completed, it could represent a significant breakthrough in the effort by President Barack Obama and his allies to restrict guns in the wake of the mass shooting at an elementary school in Newtown, Conn., that killed 26 first-graders and staff last December.

The aides said the potential deal is being worked on by Democratic Sen. Joe Manchin of West Virginia and Republican Sen. Pat Toomey of Pennsylvania. Manchin is a moderate with an A rating from the National Rifle Association, while Toomey has solid conservative credentials.

The aides spoke on condition of anonymity to disclose private negotiations.

Should you make mortgage payments later because of inflation?

From a purely financial standpoint, saving payments for a higher inflation rate makes sense. But that line of thinking neglects several key things.?

My brother has argued with me that I shouldn?t make any extra payments on our mortgage because we?re losing money over the long term by making early payments. He says that with inflation at 3% and our money able to earn 1% at minimum in a savings account and more if we do other things, we?re losing money by making early payments on our 3.75% mortgage. What do you think?

From a purely financial perspective, your brother does have a good point. However, your brother?s case has a bunch of implied assumptions that don?t necessarily apply to your situation.

First, let?s look at the math of the situation. Let?s say that you get a raise at work that equals the rate of inflation. Since your mortgage payment stays the same (assuming it?s a fixed rate mortgage), that means that your mortgage payment will take up a smaller and smaller percentage of your income over time. With the percentages expressed by your brother, your mortgage payment will take up only about a third as much of your income by percentage during the last year of your mortgage compared to the first year of your mortgage.

Want real numbers? Let?s say your monthly mortgage payment is $1,000 and you bring home $30,000 a year. Right now, you?re paying $12,000 a year in mortgage payments, which is 40% of your take-home pay. Each year, though, you?re getting a 3% raise. After ten years, you?re making a little over $40,000 a year, dropping your mortgage payments down to only 30% of your take-home pay. After twenty years, you?re bringing home around $54,000 per year, dropping your mortgage payments down to about 22% of your take-home pay. During the last year of your mortgage, you?re bringing home $72,800 per year, making your mortgage payments around 16% of your take-home pay.

The argument against early payments is that at the point where mortgage payments make up 40% of your take-home pay, it doesn?t make sense to pay even more just so that you eliminate payments at a later date where the payment is only taking up 16% of your take-home pay.

That?s a pretty powerful argument. It forgets a few things, though.

First, it assumes your income steadily increases at the rate of inflation or better. The truth of the matter is that wage growth isn?t keeping up with inflation in most industries and, in many industries, wages are actually seeing negative growth.

Most Americans can?t rely on the idea that their wages will routinely go up. That?s just not reality for the majority of people out there. Yes, there are people who are smart and work hard and have an entrepreneurial bent and a big pile of transferable skills who can keep increasing their wages, but that?s not something you can plan on unless you?re exhibiting confidence bordering on arrogance.

Second, it assumes that you can earn a sizeable steady return from a small investment. If you have $500,000 sitting in the bank, you can probably find some ways to invest it that can earn a nice return on that money, better than the 4% or so return you might get from other things. It?s much harder to do that with $1,000 in the bank.

Most Americans do not have the capital on hand to buy a rental property. Many Americans struggle to have an emergency fund. With an extra mortgage payment, a person can get a steady 3.75% return (in the mortgage example above) from every single dollar they pay ahead on their mortgage.

Third, it assumes an inflation rate. The Consumer Price Index, which is likely the best tool for estimating inflation, has only touched 3% once in the last several years and is usually around 1.5 to 2%. Some people debate whether CPI is a good measure of inflation and some argue for other rates, but CPI is a pretty solid benchmark for inflation.

Inflation does vary over time, but we?re currently in a period of very low inflation. Most inflation-based arguments rely on an inflation rate of at least 3% for people to make financial moves based on the inflation rate.

Finally, it assumes inflexibility. If you?re in a position where inflation is at 5% and savings accounts are paying a 6% return, it makes a lot of sense to put money into a savings account and make minimum payments on a 3.75% mortgage. On the other hand, when we?re in the position we?re at now, with savings accounts paying 1% and inflation somewhere around 2%, you?re going to want different solutions. Just because you choose to make early payments now doesn?t mean you can?t choose to do something differently later on.

In the end, the decision to make early mortgage payments or invest in something else is a minor point compared to the real issue. As long as you are spending less than you earn, you?re getting ahead. If you?re spending $100 less than you?re earning each month, you blow away any investment returns you might get on that $100 by instead figuring out how to spend $150 less than you earn each month. Spending less than you earn is the real key to financial success, regardless of how you invest it.

For years, his name wasn?t known, until authorities matched a partial fingerprint from a cabin window to a California man who disappeared in 2002 after running afoul of authorities in the Golden State. But before then, motion-trigger cameras had caught several snapshots of the elusive, mysterious and possibly dangerous ?mountain man,? sparking widespread debate about his identity.

On Tuesday, Knapp?s nearly seven year walkabout ended after a tip brought local law enforcement to his tracks, which they followed to a cabin where they could hear someone chopping wood. After a brief shootout, Knapp dropped his rifle and said, reportedly with a smile, ?Good job, you got me.?

Knapp has been charged with a string of burglaries across several counties, and he will also face attempted murder charges for his decision to shoot at a law enforcement helicopter, which also traded fire with Knapp. No one was hurt.

To many in the area, Knapp had become a menace, even terroristic. In a January 27 court filing, authorities claimed he had begun to leave threatening notes, including one that said, ?Hey Sheriff ? Gonna put you in the ground!?

Sometimes he left cabins spotless, other times he wrecked them. Meanwhile, theories blossomed about his identity: Was he one of the ?lost boys,? members booted from a polygamous sect in the area, who also, like Knapp, have an affinity for coffee and alcohol pilfered from the cabins?

Finally, as Knapp himself reportedly is regaling deputies with stories about his adventures, a more poignant question has emerged: Was Knapp a true ?mountain man? who felt justified in using others? property because they were intruders on ?the mountain.? Or was he a lightweight cat burglar, incapable of real bootstrap survival. Either way, Knapp never hurt anyone. He told a couple of hikers who later tipped off police, ?Not to worry, I won?t shoot you.?

Similar questions arose after the capture of Olympic bomber Eric Rudolph, who had lived in close proximity to the North Carolina town of Murphy for years, surviving most likely with the help of locals.

Mr. Rudolph, experts said, stayed in a ?comfort zone? at the edge of society. ?I don?t believe he was a good survivalist,? Kevin Reeve, director of the Tom Brown Tracking School, said in 2003, at the time of Rudolph?s arrest.

Knapp didn?t seem to have the same need for human proximity. In fact, his motive seems to come down to a credo he gave police: ?I don?t hate people. I just don?t like them.?

But his exploits haven?t impressed everyone.

?Troy James Knapp ? is so far from being a true mountain man it isn?t even funny,? writes Michael Gist Burson in a letter to the editor of the Standard-Examiner newspaper in Ogden, Utah. ?Real mountain men, like Jedediah Strong Smith, didn?t break into others? cabins in order to survive in the wilderness. For punishment, Knapp should be put into the wilderness with nothing. We?ll see if he really has what it takes to be a true mountain man.?

US general: Taliban likely to be long-term threat

(AP) ? The United States accepts that a diminished but resilient Taliban is likely to remain a military threat in some parts of Afghanistan long after U.S. troops complete their combat mission next year, the top U.S. military officer said Sunday.

In an Associated Press interview at this air field north of Kabul, Army Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, said he is cautiously optimistic that the Afghan army will hold its own against the insurgency as Western troops pull back and Afghans assume the lead combat role. He said that by May or June, the Afghans will be in the lead throughout the country.

Asked whether some parts of the country will remain contested by the Taliban, he replied, "Yes, of course there will be."

"And if we were having this conversation 10 years from now, I suspect there would (still) be contested areas because the history of Afghanistan suggests that there will always be contested areas," he said.

He and other U.S. commanders have said that ultimately the Afghans must reach some sort of political accommodation with the insurgents, and that a reconciliation process needs to be led by Afghans, not Americans. Thus the No. 1 priority for the U.S. military in its final months of combat in Afghanistan is to do all that is possible to boost the strength and confidence of Afghan forces.

Shortly after Dempsey arrived in Afghanistan on Saturday, the Taliban demonstrated its ability to strike.

It claimed responsibility for a suicide car bombing that killed five Americans ? three soldiers and two civilians, including Anne Smedinghoff, a foreign service officer and the first American diplomat killed overseas since the terrorist attack Sept. 11 in Benghazi, Libya.

A fierce battle between U.S.-backed Afghan forces and Taliban militants in a remote corner of eastern Afghanistan left nearly 20 people dead, including 11 Afghan children killed in an airstrike, Afghan officials said Sunday.

There are now about 66,000 U.S. troops in Afghanistan. That number is to drop to about 32,000 by February 2014, and the combat mission is to end in December 2014. Whether some number ? perhaps 9,000 or 10,000 ? remain into 2015 as military trainers and counterinsurgents is yet to be decided.

Dempsey spent two days talking to senior Afghan officials, including his counterpart, Gen. Sher Mohammad Karimi, as well as top U.S. and allied commanders.

He also visited a U.S. base in the volatile eastern province of Paktika for an update on how U.S. troops are balancing the twin missions of advising Afghan forces and withdrawing tons of U.S. equipment as the war effort winds down.

Paktika is an example of a sector of Afghanistan that is likely to face Taliban resistance for years to come.

Bordering areas of Pakistan that provide haven for the Taliban and its affiliated Haqqani network, Paktika has been among the more important insurgent avenues into the Afghan interior.

While the province has a functioning government, Taliban influence remains significant in less populated areas, as it has since U.S. forces first invaded the country more than 11 years ago.

"There will be contested areas, and it will be the Afghans' choice whether to allow those contested areas to persist, or, when necessary, take action to exert themselves into those contested area," he said.

Dempsey said he is encouraged by the recent development of coordination centers, including one in Paktika, where a wide range of Afghan government agencies work together on security issues. He called it a "quilt" of government structures that links Kabul, the capital, to ordinary Afghans in distant villages.

In some parts of the country, Afghan villagers have shown their dissatisfaction with Taliban influence by taking up arms against the insurgents, even without being pushed by the U.S. or by Kabul. This has happened in recent weeks in the Panjwai district of Kandahar province, a traditional stronghold of the Taliban. The Andar district of Ghazni province has seen a similar uprising.

"We should encourage it, but we shouldn't be seen as hijacking" these local movements, he said.

Dempsey said he discussed the uprisings with Karimi, the army chief, and the Afghan defense minister, Bismullah Khan Mohammadi. They told him they "appreciated that they should allow this to occur (and) they should probably nurture it. They don't necessarily feel at this point as if they should tangibly support it."

The Afghan government's concern, Dempsey said, is that influential warlords could embrace these local movements and eventually leverage them to threaten the armed forces of the central government.

In a separate interview Sunday with al-Hurra, the Arabic-language satellite TV channel funded by the U.S. government, Dempsey was asked whether he worries that Syria, in the midst of a civil war, could become another Afghanistan.

"I do. I have grave concerns that Syria could become an extended conflict" that drags on for many years, he said.

What a week it's been. Last I wrote I was in Florence taking an easy day as I was not quiet feeling 100%. I can happily report I got over whatever that was quickly and so enough of that!

The day after the last blog post I hopped on a train heading to Rome to go and see Papa Francesco for Easter weekend. Upon arriving in Rome, I met up with some fellow travelers from the previous hostel that just so happened to be staying at the same hostel in Rome. And clarify what I mean by "hostel" I mean campground outside of Rome. This is the result of being cheap and booking late for Easter weekend. (more on this later)

First day in Rome was spent with my friends were only spending a day in the eternal city. We therefore did a bit if a whirlwind tour of a lot of the main sights, including such places as the Trevi Fountain, Pantheon, The Roman Ruins, The Colosseum and The Vatican. Really mind blowing to try and comprehend the history in that city. After a full day of exploring and audio tours and whatnot, we went back to the campground via the adjacent supermarket, had dinner and passed out after a long day of walking. The flowing day after saying goodbye to my friends, I went to the Coliseum to make sure I was there early for the Good Friday candlelit vigil with the Pope. My patience paid off as I was fortunate enough to be right up front and center by the pope for the vigil. An amazing experience worth the 10 hours I out into it. The pope in front of me, the Colosseum behind me, thousands and thousands of people around me, including some fellow English speakers I was fortunate enough to run into!

The highlight of my last day in Rome was walking around an entire Country (Vatican City). I was looking for something budget wise to do and so walking seemed like a good choice! Also went to the Spanish steps, and ate lunch in a beautiful park overlooking to whole city. Really enjoyed how many things there were to see in Rome. Good for ADD people like .. I was happy to leave the city however as Rome is very very brigand very busy, and so there was just the constant stress of being in a metropolis. I therefore headed to a farmhouse in Perugia, a recommendation from a traveler I met a while back. And what a good recommendation it was!

As soon as I arrived at the farmhouse, I was relaxing. I was in the middle of nowhere overlooking the hills of Umbria all around me with the medieval hilltop city of Perugia off in the distance. And to my surprise, I ran into two French Canadian travelers that I had met earlier in Florence. Right away I was amount friends and having a blast, as before even settling in, I was in the middle of a full on round the world ping pong tournament out on the lawn. I spent the week relaxing with new and newer friends in the beautiful countryside, enjoying the fact that I had a full kitchen and therefore the capability for fresh food! What a concept! Made all sorts of yummy things from fresh veggie salads to homemade iced tea to omelets galore and various other yummy dishes. Went to a local micro brewery and had a feast of fresh homemade meat and beer. Went to Assisi, a town near by where St. Francis was born and lived. Amazing to see such incredible history in such a small town, including a small church hand made by St. Francis himself which they have since built an entire basilica around. The entire Perugia experience was great, and I was still not wanting to leave after my 5 nights (originally only planned two). For any of you that ever come to Italy, the rural Perugia Farmhouse is worth a visit.

I am currently sitting on a train having just left Perugia this morning, heading to Rimini for the weekend.

BUT WAIT! There is something I haven't mentioned yet. To my incredible surprise, I have met up with my longtime friend Regen. He emailed me last week saying he had just arrived in Torino of all places, and so we met up in Perugia two days ago and now are planning on traveling together for a bit headed in a east via north east direction. Funny how plans change! But it will be great to have a travel partner for a little bit.

I really don't know where I'm headed other then two days at a time, so who knows where I'll write from next week! (hopefully not late like this post!..sorry!)

Lockup recommended for man who sneaked into jails

NEW YORK (AP) ? A man who repeatedly used phony credentials to gain entry into New York City's jails may get his wish to do more time.

Prosecutors told a judge on Thursday that they want Matthew Matagrano to be locked up for 10 years. Matagrano, a former inmate, pleaded not guilty to felony burglary in Manhattan Supreme Court.

The judge doubled his bail to $100,000 and ordered him to get medical attention.

The New York Post (http://bit.ly/ZbNv0w ) reports that according to police statements released in court, Matagrano said he repeatedly sneaked into jails because the people inside were "nice" and made him "feel important."

Authorities say Matagrano tried to get inside multiple city lockups, including Rikers Island and the Manhattan Detention Center, where he mingled with inmates for hours.

Can the EU stop Hungary's controversial constitutional amendments?

Hungary's new constitutional amendments, which critics say erode the power of the Constitutional Court and violate EU law, came into effect on Monday.

Amid growing concerns that the Hungarian government has taken steps to centralize power and weaken democratic principles in the country, a growing movement in the European Union is considering what should be done to keep Hungary in line.

On Monday, the latest set of amendments to the Hungarian constitution ? the fourth set since its passage in 2011 ? came into effect, having been pushed through by Prime Minister Viktor Orb?n and his conservative Fidesz party?s two-thirds majority in parliament.

Critics say the new amendments erode the authority of the Constitutional Court, which overturned several Fidesz-backed laws in recent months. Hungary has also clashed with the EU regarding changes to the country?s media laws and the independence of its central bank.

Last week, EU Justice Commissioner Viviane Reding said the changes in judicial independence in Hungary were ?very worrying,? according to Dow Jones. The Hungarian government responded by stating on its website that Ms. Reding was ?waging private war against Hungary.?

Curtailing the Constitutional Court?

Reding is not alone, however, and critical voices from the EU have been increasing. European Commission President Jos? Manuel Barroso also expressed concern and spurred the Council of Europe (CoE), an independent human rights organization, to investigate whether the amendments conform to EU law.?

The amendments limit the Constitutional Court?s ability to refer to its own rulings prior to January 2012, when the current constitution came into effect, thereby effectively cutting a large portion of established legal decisions out of the country's law. Instead, the amendments restrict the court to only reviewing amendments to the constitution based on procedural requirements, rather than substance.

?There is nothing to be concerned of,? says J?zsef Sz?jer, member of the European Parliament (MEP) from Fidesz. Mr. Sz?jer says the amendments are ?not curtailing the powers of the Constitutional Court but expanding it? by giving the court the ability to determine if new amendments follow proper constitutional procedures.

Hungary welcomes the review of the CoE, he says, but constitutional affairs of member states should be respected by the EU.

But CoE spokesman Panos Kakaviatos said in an email that his organization was concerned that the amendments include provisions that were previously rejected by the Constitutional Court, as this ?could endanger the fundamental principle of checks and balances in a democracy.? By incorporating the provisions into the constitution itself, Fidesz effectively does an end run around the court, realizing the changes that the court rejected as undemocratic.

The results of the CoE?s review are expected to be released in June.

EU institutions have shown varying degrees of political will to act on Hungary. The Commission has been relatively cautious in its criticism, while MEPs have been more vocal.

?The Commission is after all a neutral arbitrator,? says Agnes Batory, public policy professor at Budapest?s Central European University. ?They cannot act in an overtly political way, as opposed to party groups within the European Parliament.?

Nuclear option

As for what to do now, the EU has several options at its disposal.

The most serious option is launching Article 7 procedures ? also referred to as the ?nuclear option? ? against Hungary.? Those procedures can strip a country of some of its rights within the EU, including voting rights, if found in serious breach of fundamental values relating to democracy, human rights, and the rule of law.

In 2012, EU Commissioner for the Digital Agenda Neelie Kroes said she would consider asking the Commission to apply Article 7 if Hungary did not reform its media laws. MEP Guy Verhofstadt has also recently stated he would call on the European Parliament to initiate these procedures over the constitution issue.

However, Article 7 has never been used and it is unlikely to be invoked in Hungary?s case. A four-fifths majority in the European Council would be required, and such consensus in the EU is rare. Countries are also reluctant to establish a precedent by allowing the Union to interfere in constitutional matters.

Other options

Alternatively, the EU could impose economic sanctions. Under the excessive deficit procedure (EDP) ? a tool that allows Europe to rein in member-state budgets ? it can strip "cohesion funds," which finance development projects, from states that do not keep budget deficits below 3 percent of GDP.

Although this procedure is related to financial indicators rather than democratic ones, the Commission could use the threat of economic sanctions as leverage on the constitutional issue. This approach may be ?the clearest line of pressure? on the Hungarian government, says Ms. Batory.

Hungary is already being monitored under the EDP and, in 2012, the EU temporarily suspended 495 million euros ($636 million) in funding to the country for failing to take sufficient measures to reduce its deficit. The suspension was lifted a few months later, after Hungary proved that it was implementing the EU?s recommendations and was set to reach its deficit target for the year.

The European Commission can also file infringement procedures where it believes a member state is in breach of EU law. This judicial mechanism has been used to tackle specific legislation in Hungary deemed to violate EU regulations, such as a law that reduced the retirement age of judges from 70 to 62. However, infringement procedures must be launched against specific laws and cannot be applied to broader violations of values and human rights in the country.

Many in the EU are waiting for the results of the CoE?s review before deciding what steps to take next. Still, an increasing number of voices suggest something needs to be done.

?We cannot say this is not a problem of the European Union and only a problem of the Hungarian people,? says Mate Daniel Szabo, director of the E?tv?s K?roly Institute think tank. ?Because at the end of the day, there will be a country in the middle of Europe where the government is unchangeable and the idea of constitutionality is forgotten.?

Marriage can threaten health: Study finds satisfied newlyweds more likely to gain weight

Apr. 3, 2013 ? On average, young newlyweds who are satisfied with their marriage gain weight in the early years after they exchange vows, putting them at increased risk for various health problems related to being overweight.

That is the finding of a new study on marital satisfaction and weight gain, according to psychologist Andrea L. Meltzer, lead researcher and an assistant professor at Southern Methodist University in Dallas.

"On average, spouses who were more satisfied with their marriage were less likely to consider leaving their marriage, and they gained more weight over time," Meltzer said. "In contrast, couples who were less satisfied in their relationship tended to gain less weight over time."

The study's researchers said the findings challenge the long-held notion that quality relationships are always beneficial to one's health. Instead, they said, the findings suggest that spouses who are satisfied in the marriage are less motivated to attract an alternative mate. As a result, satisfied spouses relax efforts to maintain their weight.

The article, "Marital satisfaction predicts weight gain in early marriage," is published online in the scientific journal Health Psychology.

The study was based on data from 169 first-married newlywed couples whose marital satisfaction and weight were tracked over the course of four years.

Marriage associated with weight gain; divorce associated with weight loss

Previous psychological research has established that marriage is associated with weight gain and that divorce is associated with weight loss. But the role of marital satisfaction in those changes in weight is less clear, Meltzer said.

Previous research also has demonstrated that marital satisfaction is associated with health maintenance behaviors, she said.

"For example, studies have found that satisfied couples are more likely to take medications on time and schedule annual physicals," Meltzer said. "Yet the role of marital satisfaction and actual health is less clear."

Meltzer set out to examine the association between marital satisfaction and changes in weight over time.

For four years, the newlyweds reported twice a year on their marital satisfaction and steps toward divorce. They also reported their height and weight, which was used to calculate their body mass indices.

Focus on maintaining weight is more about appearance than health?

Spouses who were less happy in their marriage were more likely to consider leaving their partner, Meltzer said, and on average gained less weight over time.

"So these findings suggest that people perhaps are thinking about their weight in terms of appearance rather than health," she said.

The study suggests young couples should be educated and encouraged to think about their weight as a factor of maintaining their health.

"We know that weight gain can be associated with a variety of negative health consequences, for example diabetes and cardiovascular disease," Meltzer said. "By focusing more on weight in terms of health implications as opposed to appearance implications, satisfied couples may be able to avoid potentially unhealthy weight gain over time in their marriages."

Besides Meltzer, co-authors are James K. McNulty, Florida State University; Sara A. Novak, Hofstra University; Emily A. Butler, University of Arizona; and Benjamin R. Karney, University of California, Los Angeles.

The Convergence of Information Security and Risk Management ...

Threats to information security are real and constant, and there are so many avenues that affect an organization?s risk posture?internal, external, loss, theft, cloud computing, social media and mobile devices.

Security professionals may think they will never win the battle. Just ask any of the 80 percent of organizations that have experienced a data breach over a 12 month period.

2012 Data Breach Investigations Report (.pdf here) states:

  • 97% of breaches were avoidable through simple or intermediate controls (+1%)
  • 96% of attacks were not highly difficult (+4%)
  • 94% of all data compromised involved servers (+18%)

Despite the continuous threat to data and its potential impact on business, there remains a lack of connection between information security officers and those at the executive levels. As reported in the 2012 CyLab Report from Carnegie Mellon University (.pdf here) nearly 75 percent of all organizations don?t report on security risks to the C-suite level.

This is particularly true of critical infrastructure industries, such as energy and utility companies, where threat is of the highest national urgency.

Overcoming Security Stereotypes

This disconnect may be a result of the way in which businesses have traditionally viewed IT and security personnel?as ?geeks in lock-down mode? and security incidents as ?nuts and bolts? events. This is troublesome since the collateral damage from security vulnerabilities and threats is at an all time high.

A single, major data breach can mean a loss of revenue and reputation; it can disrupt business; and, it can result in millions of dollars in fines and expensive remediation. It is for these reasons that security risk management is finally catching the attention of the C-suite. Yet only one in eight organizations feel information security can influence business decisions (.pdf here).

According to the Security for Business Innovation Council (.pdf here), 2013 will continue to test information security?s mettle, despite the fact that info sec teams have long lobbied to be business enablers, not inhibitors. But again, there is a disconnect, one that thwarts this important goal?a communication gap.

To paraphrase a popular self help book from the 1990s, security speaks in Mars, and business speaks in Venus. With risk nipping at the heels of business 24/7, it?s time that both parties speak the same language.

However, the responsibility should fall to security?s shoulders on this issue. In order for security issues to converge with overall strategies, information security executives must learn to communicate in business language that can be understood across the organization.

Five Tips for Connecting Security to the Business

  • Understand that security is not a technical problem, but rather a dimension of the quality of products and services a business delivers
  • Align security priorities to the different categories and objectives of the business
  • Articulate to the CFO the potential financial loss of a data
  • Communicate to the sales organization that a data breach makes it harder to gain and retain customers
  • Learn to talk the C-Suite language up and down the organizational chain

NEW YORK (AP) ? Call it satisfaction: The Rolling Stones have announced a nine-city tour.

The veteran rockers said Wednesday their "50 and Counting" tour will kick off in Los Angeles at the Staples Center. The date will be announced later.

The second show is in Oakland, Calif., on May 5. The tour will also visit San Jose, Calif.; Las Vegas; Anaheim, Calif.; Toronto; Chicago; and Boston. The tour ends June 18 in Philadelphia.

Tickets for Oakland, San Jose, Toronto and Chicago go on sale April 8. Ticket sales for the other cities will be announced later.

The band will also headline the Glastonbury Festival on June 29 and will perform at London's Hyde Park on July 6.

Former band mate Mick Taylor, who was a member of the Rolling Stones from 1969 through 1974, will be a special guest throughout the tour.

The foursome celebrated their 50 anniversary late last year, playing five sold-out shows in New York, New Jersey and London. Special guests included Bruce Springsteen, Lady Gaga, the Black Keys and Mary J. Blige.

"We did a few shows in London and New York last year ... and had such a good time that we thought ... let's do some more," Mick Jagger said in a statement. "It's a good show."

"From day one at rehearsals it sounded so fresh. You could tell that everybody was dying to get their teeth into it," Keith Richards said. "... it is the life and blood of us to play in front of people."

The band released a 30-second video early Wednesday featuring Jagger, Richards, Charlie Watts and Ronnie Wood chatting about getting together again.

Wood says in a video conversation over the computer with his band mates: "Well it's about time kids. I've been waiting for this call."
